EDIT: I just read your comment about the Nice my Five Moods… Too Old For This Tired For This Owl T-Shirt it is in the first place but 10% being on the total value of the estate, rather than the half given to each person. Yeah, that’s a lot neater than what I thought you were saying. Bit of a tough break on your sister, but then there’s always going to be toss-ups on that front when you’re dividing up an estate I guess. Practically speaking, all this seems pretty fair and reasonable. Point still stands about how your dad is always able to change his mind on how he wants to split things, but as it stands it looks pretty OK to me. If he wants to be that specific then he just needs to name each of the kids. He can give each child an equal portion at whatever percentage he likes and the rest is split between you and your sister.

If your sister has an issue with it then she needs to go back to your dad. His will is his choice and his problem to resolve with her. The only correct answer is this. If the wording of the will is how you’ve put it, I’d get some clarity if I were you because there’s a few interpretations in this thread already. I read it as you and sister get 50% each, and your children get 10% of the whole from your share. If right, this would leave you with 30% of the pot and your sister with 20%. I can see how she would want it changed to the grandkids getting a straight 10% and the difference being split, because then you both get 25% and any future children she has would deduct from you both. She needs to stop being greedy. It’s clear as day in the will , split 50/50 between you and her. It’s no one else’s fault she has an extra child but hers. She gets her cut and can give what she sees fit to her children. I’d make sure your father has it written out well to dictate exactly how it’s split and cant be read into any other way. Yikes, you are in a firm position here buut I would suggest he instructs for an independent third party to handle it all; I speak from experience as a Grandchild. My grandfather left an equal split between his four kids to be given equally to their kids when Over 18; the two who had the majority of the kids were not then & still not happy from what I have been told by my Uncle, Grandmother & Parents. I said when I was 16 just to let them have it all. Over ten years later, I’m still appalled by the wider family & by all accounts, far more successful too. All ten of my cousins are Oxford educated!
