The contract states the daily rate is £55 and holiday entitlement is extra. The amount I’m paid hasn’t changed but the separate “holiday” payment that has appeared on the pay slip is a percentage of the total and doesn’t bear any relation to or can not be calculated to equal and part of holiday pay and the basic pay element now takes my pay down to £46.85 a day instead of the £55 in my contract.

Essentially you get 11% of hours worked back in holiday pay. So you get £55/day which includes your holiday allowance. I saw that you said you work 4.5hr/day so your hourly wage works out as £11.01/hour. Minimum wage is going to be £11.44 as of April. For it to work the way they claim, they’d have to be paying you £1.12 an hour above living wage – so £11.54 until April, and £12.56 after that, based on 5 days a week of work. Doubt they’re complying to this properly. Definitely dodgy dealings if they’re trying to stop you talking to each other as they legally cannot enforce that. Acas and union time!

It sounds like they’ve issued generic contracts and not changed them to suit. You signed a contract for 28 days paid leave annually and no additional terms, and no mention that you get paid enhanced hourly rate to cover the days off you’re not taking, then they’re in trouble. Just checking, you mentioned you worked in the education sector, do you get school holidays off work or do you work them? In the months when you have the school holidays off so you get paid the same amount as the none school holidays? No we don’t get paid for the holidays, like a TA we get paid 39 weeks of the year and this is pro-rata’d out over 12 equal monthly payments.
