I’m not sure. They filed a lawsuit against my grandmas nursing home in a separate case and won. I think they were made administrator then. Yes! We also brought the issue up to the judge a few days ago when the motion to close estate was held. They basically asked if we were going to get a lawyer. Please get a lawyer as soon as possible. Document everything from the start. Get any written statements, documents, pictures, literally everything. Statements from everyone that is involved, etc. “Not Deserving” the money isn’t a valid reason for not giving it to the beneficiaries. The judge very well knows that. Info: was the estate administrator also named as a beneficiary in the will? If not, they didn’t make a mistake about the check they received and just decided to take all the funds. Even if they were also a beneficiary, as the estate administrator, it is their responsibility to understand what debts and assets the estate has, before distributing any funds to beneficiaries. My meaning is that they should not have spent any funds on themselves until they had a full accounting of estate assets and debts. I hope you can find some sort of legal help (maybe even a non-profit) that would help you file against the estate administrator.
