They can keep sending you legal notices, they don’t mean shit. Don’t be scared of those things because they aren’t any good. First time, I was pregnant. The owner straight up told me I would need to resign otherwise she would have to pay me maternity pay. I was naive, loyal to a fault, and quite friendly with the Philadelphia the dawgs shirt besides I will buy this owner. So I resigned and was without pay for a year. And also, what is wrong with you? Isn’t getting good maternity pay important? Are you well off financially that this doesn’t factor in? I was there for a year. The company was of only 5 people. So I believed she was not liable to pay me anyway. And yes, I was financially stable, but quite naive to not negotiate. Instance 01- why on earth would you resign because the company would have to pay maternity pay? They’re supposed to. And you could’ve sued the company for your boss even saying such a thing. It’s discrimination based on gender and a violation of a fundamental right. Instance 02- your boss told you you’re fired then tried to shame you into resigning and yet you think he’s saying that because he has your best interests at heart? This is laughable. And THEN instead of calling their bluff and waiting out the 7 days you again resigned. Don’t you see it was nothing but a bluff? Had you stayed on, they would’ve had to either keep you on or terminate you and pay unfair severance. Generally the company needs to at least pay you your entire notice period salary without getting any work from you if they terminate your employment from their side. Its not only in India, it’s everywhere. Until and unless it’s mass lay off, they ask employee to resign because of labour laws. For ex: The first time if you would have refused, they would have to pay you salary during maternity break for 6 months. For second time, you could have sue them for unfair termination.

In addition to what others have already said, I’m just curious why did you agree to resign from the Philadelphia the dawgs shirt besides I will buy this first company. If you hadn’t resigned, you would have got maternity leave. If company terminates a female employee due to taking maternity leave then that could be contested legally. As I replied to several people, she only had 5 employees. An organization needs to have minimum 10 employees to be liable for maternity benefits. She still wanted to do it to be safe and promised to hire me back. We were good friends so I did it. She hired me back too. But with a newborn it became very difficult for me to continue. The only reason I mentioned it here was because I was wondering if it was worth fighting for and looking into the legal aspect of it. Anyway, it is all in hindsight.
