“X% of my estate to be split equally between all my biological grandchildren. Remaining 100-x% to be split between all my children. In the Awesome easily Distracted by Rabbits and Books T-Shirt and I will buy this event of any of my children pre-deceasing me, their share shall be split between all their surviving children” I still think you are wording this wrong. If it’s been divided between you two 50/50 then there is nothing left after that to divide. My siblings and I all had an equal split after his other disbursement amounts for each grandkid and his ex wife (my mum) and sister. I have one child my brother had two. Two other siblings had no children so we’re disappointed to miss out on what was essentially 2k. Dad made his wishes clear. I as executor fulfil that. It’s tough. Caused some feelings but mostly they have moved on now. I still think you are wording this wrong. If it’s been divided between you two 50/50 then there is nothing left after that to divide.

I think it’s saying, Grandad wants to give both parents 50% of his estate, on the Awesome easily Distracted by Rabbits and Books T-Shirt and I will buy this condition that each parent give to each of their children 10% of what they are given . So in percentages of total estate; sister will get 35% for herself and each of her children 5%, and OP will get 40% with each of his children getting 5%. So in percentages of total estate; sister will get 20% for herself and each of her children 10%, and OP will get 30% with each of his children getting 10%. So in percentages of total estate; sister will get 35% for herself and each of her children 5%, and OP will get 40% with each of his children getting 5%. Agreed – a will should be written more clearly… and in a way that it cannot add up to more than 100% (e.g. if either side had more than 5 kids). *OR* – Split evenly between the kids – encouraged to leave some to grandkids. (Split evenly among grandkids in case kid predeceases me) *OR* – Split evenly between kids – with % of kids share (not of total) for each grandkid. (Kid’s portion split evenly among that side’s grandkids if kid predeceased me) Any good will should account for the possibilities of more grandchildren being born, children passing, grandchildren passing, etc.
